I don't know

First off I do fully think the reason why Kaepernick doesn't have a job in the NFL is cause the owners got together and decided not to employ Kaepernick. I firmly believe that.

That being said I don't know how this lawsuit will help. Even if he wins if the case gets appealed to the Supreme Court we know how they will rule.

I think it's far more likely that the NFL owners know that hiring Kaepernick subjects their organization to a hornet's nest of controversy, media, and fan scrutiny that they would not want any part of.

Quarterbacks are the face of the franchise. Owner's are going to be careful of who that face is. The Eagles got a lot of flack for hiring Michael Vick. If Kaepernick wasn't a quarterback, things would likely be different.

They got flack but they signed him and Vick won them over. Kaepernick isn't getting that chance.

So why should he? The owners have the right to each do a risk-reward analysis. Vick had several good years with the Falcons. Kaepernick only had one really good year. He's more of a risk.

Put aside your personal beliefs for a minute and think about what if you owned a business and there was a potential employee with a lot of baggage that could potentially harm your business. Would you hire him when there are other candidates available?
